A lawsuit filed by the Third Baptist Church against a non-profit group it founded, Third Baptist Gardens Inc, has been settled out of court.

The lawsuit was filed last July, after Third Baptist Gardens (the board in charge of Frederick D. Haynes) moved forward with plans to sell the 108-unit building, which offers 80 percent of its units as Section 8, city-funded housing for low-income residents. 

Yesterday, the Chronicle reported that the nonprofit's board resigned in exchange for the lawsuit being dropped, and 11 new board members were elected in their place. City Attorney Louise Renne told the Chron that the settlement ensures that the complex will stay affordable, marking a win for low-income housing preservation in the Western Addition.
