Following the last week's news that the city had given it a deadline to apply for a change-of-use permit, Haight Street Gelato, the new ice cream shop operating at 1782 Haight St., appears to be going through the required process to become legally compliant and stay in business.

The gelato shop was in jeopardy after a neighboring business owner filed an anonymous complaint, noting that it had not acquired the proper permits to serve food.

The change-of-use application, filed yesterday, would transition the storefront from a "specialty market" (as permitted when it was the Fizzary) to a "limited restaurant," which would make Haight Street Gelato legally compliant in serving food and beverages and having limited seating.

The next step is a legally required 30-day wait, providing an opportunity for neighbors to voice opposition to the application before final approval.

Bruno Martin, named as the business's owner and operator, was unavailable for comment at the time of this posting.
