Jose Gaytan, a 31-year-old parolee from Redwood City, was sentenced to 16 months in state prison on Wednesday, for making felony threats to two individuals in February. Gaytan has a long criminal record and the prosecution sought a four-year sentence, as revealed in a tweet by the San Mateo County District Attorney's Office. However, the judge struck a prior strike conviction from the sentencing, resulting in the reduced prison term.

On February 26, Gaytan confronted a victim at a park in Redwood City around noon. In response to the intimidation, the victim called his uncle, who met him at a local shopping center. Gaytan followed them to the center, where he continued to yell expletives and threaten the victims. At one point, Gaytan left his car, approached the uncle, challenged him to a fight, and insinuated that he had a gun. A nearby witness overheard the altercation and quickly contacted the police, as reported by the San Mateo Daily Journal.
