The dozens of tenants who reside at 1049 Market St. are preparing for a fresh battle to keep their rent-controlled homes.

Since 2013, the building's owner, former professional baseball player John Gall, has been attempting to evict residents who were allowed to rent live/work units in the building for less than market rate, despite the building being zoned for commercial use.

While the Board of Supervisors passed legislation last March that enabled the renters to stay in their homes for another year, that legislation has now expired, and the tenants were served Ellis Act eviction notices on Feb. 23rd of this year.

At a press conference hosted by the tenants and tenants' rights organizations yesterday, District 6 Supervisor Jane Kim said she will continue to fight on behalf of the tenants, the Examiner reported.

However, Gall’s attorney also told the paper that the tenants haven't paid rent in over two years, and he's filed a lawsuit against the tenants and the city for "significant damages."
