A 29-year-old Santa Rosa man, Vincent Cervantes, received a sentence of nine years in state prison for attempted second-degree murder and assault with a semi-automatic firearm, according to the Sonoma County District Attorney's Office.
The sentencing followed Cervantes' pleading of "no contest" in July 2023 to the charges stemming from a shooting incident on November 11, 2022 that occurred at the Santa Rosa Creek. Cervantes, a convicted felon, was prohibited from owning a firearm due to his criminal record, but that did not deter him from approaching a male and female on the creek path and firing three rounds from a semi-automatic weapon at the male, missing both victims. Fortunately, no one was injured in the confrontation, but the situation could have easily resulted in devastating loss of life or serious injury.
The District Attorney, Rodriguez, noted the inherent danger of such reckless actions, stating, “This was a reckless and incredibly dangerous action on the part of this defendant. Although nobody was injured as a result of this criminal offense, the discharge of a firearm has obvious potential to cause death or serious injury to not only the intended target, but anyone in the vicinity.”
Following the shooting, Cervantes fled the scene and was subsequently apprehended by a Santa Rosa Police SWAT team at a nearby apartment on Pioneer Way. The case against him was prosecuted by Deputy District Attorney Robert Rasp and investigated by the Santa Rosa Police Department. The outcome of this case highlights the potential for further harm and danger to communities when individuals with criminal records have access to firearms despite prohibitions.
