
In Texas, a recent ruling from a Texas appeals court has put the brakes on the state's controversial investigations into families providing gender-affirming medical care to their transgender children. According to Fox San Antonio, the court's decision on Friday supported injunctions from a lower court that stopped the Texas Department of Family and Protective Services from probing these families.
The conflict sparked in February 2022 after Texas Governor Greg Abbott ordered investigations based on an opinion by Attorney General Ken Paxton, which labeled such parental support as potential child abuse. As reported by CNN, in the wake of Abbott's directive, the state began at least nine investigations in quick succession, despite the medical community's support for gender-affirming care as safe and essential.
Friday's ruling echoes the concerns of LGBTQ+ advocacy groups and affected families, locking in a temporary halt on alleged child abuse investigations and preserving the right to medically necessary care for transgender youth. "We are grateful the court saw through this dangerous and transparently discriminatory action by Texas officials," Chase Strangio, deputy director for transgender justice at the ACLU’s LGBTQ & HIV Project, told CNN.
Moving decisively against Governor Abbott's mandate, the appeals court echoed the sentiment that enforcing such a directive could cause "irreparable harm." The judgment upholds both parents' ability to make medical decisions for their children and the medical community's prevailing guidelines, Fox San Antonio reports. Backing this up, major medical organizations like the American Medical Association and the American Academy of Pediatrics endorse gender-affirming care for individuals with gender dysphoria.
As legal battles over Senate Bill 14, which prohibits gender-transition surgeries and hormone therapies to minors, continue to mount, the court's recent order presents a significant hold on what many view as an overreach of state power. The pending trial will further address the legality of policies enforcing investigations into families supporting their transgender children's medical needs.
