
Michigan's Attorney General Dana Nessel has decided to take a stand and join the Department of Justice (DOJ) and 29 other states in a high-stakes legal challenge against industry giant Live Nation Entertainment and its subsidiary Ticketmaster, alleging monopolistic practices that hurt consumers by inflating ticket prices and restricting buying options for live events. According to the Michigan Department of Attorney General, Nessel said "Michigan concertgoers deserve the chance to experience the thrill of seeing their favorite artist live, in a venue close to home, without breaking the bank." She condemned what she describes as Live Nation's "illegal monopoly."
The lawsuit, filed in the Southern District of New York, argues that since Live Nation and Ticketmaster's 2009 merger, the company has dominated the live music promotion world—unfairly leveraging its power to set restrictive terms with venues and inflate management fees. As detailed by the Michigan Department of Attorney General, these practices have directly harmed fans through "higher fees, lack of transparency, fewer consumer choices, and stifling innovation."
The suit's focal point is Live Nation's alleged restrictive agreements with venues, which, per the DOJ's claims, actively prevent competition by ensuring venues cannot promote events with Live Nation's rivals. Furthermore, the DOJ alleges the company has used its control of a vast network of amphitheaters to compel artists into selecting Live Nation as their exclusive promoter, effectively maintaining their stronghold over the live music promotions industry.
This concerted action seeks to not just legally penalize Live Nation but to reinvigorate the marketplace as a whole. "A truly competitive marketplace is essential to providing consumers with choice," Nessel said, per the Michigan Department of Attorney General. The coalition is pushing for the company to divest Ticketmaster and to cease its anticompetitive conduct, a move proponents argue will better serve consumers by fostering innovation and offering more choices.
The coalition backing the lawsuit includes Attorneys General from a wide political spectrum, spanning both red and blue states, which underscores the bipartisan support for challenging Live Nation’s practices. With this formidable opposition lined up against it, Live Nation is now tasked with defending its business model in court, as litigation progresses and the industry, as well as music enthusiasts, keenly await the outcome.
