In a fatal confrontation in Orion Township yesterday morning, a man who aimed to harm his ex-girlfriend was shot and killed by the woman's stepson. According to CBS News Detroit, the encounter happened just after 10 a.m. at a residence on Elkhorn Lake Road. Sheriff Michael Bouchard informed that the stepson acted in defense as Galen Gavitt, 67, broke into the house wielding an axe and a revolver.

As narrated by FOX 2 Detroit, seeking to enter the bathroom where the ex-girlfriend had hidden, Gavitt was instead met with a single, lethal gunshot by her stepson. Gavitt had previously been subject to the state's red flag laws, with two of his firearms seized after a protection order was issued. Nevertheless, finding a way, Gavitt managed to arm himself again.

Heavily emphasizing Gavitt's past threats to the woman, including an intent to kill, the Detroit Free Press reports that despite the active court orders, including an Extreme Risk Protection Order, Gavitt obtained a handgun. The ex-girlfriend had fled a 17-year relationship with Gavitt to live with her stepson and his wife, aiming for safety.

The incident highlights the partial effectiveness of the "red-flag laws," brought to light by Christine Kinal, CEO and executive director of HAVEN. Despite precautions like the EEPO, "The motive behind ERPOs is for cases just like this. It gives a little more power to authorities to take guns away from someone in an emergency," Kinal said, as per Detroit Free Press. However, Gavitt's case exemplifies the laws' limitations when individuals find ways through possibly familial channels to re-arm themselves illicitly.
