A 26-year-old Turlock man, identified as Ivan Garcia Jr., has been convicted on charges of forcible rape after juridical proceedings in Stanislaus County, as reported by the Stanislaus County District Attorney's Office. Garcia's conviction stems from a 2020 incident where he broke into an apartment on W. Monte Vista and sexually assaulted the then-sleeping victim.

According to coverage by KCRA, Garcia gained entry to the victim's apartment and assaulted them in their bedroom. Post the attack, Garcia fled the scene, however, detectives were able to connect him to the crime with DNA evidence subsequently linking him to the assault. Garcia's identification process further solidified the case against him as he had not taken any steps to conceal his identity, leading the victim to be able to positively identify him in a photographic lineup.

"The trial lasted five days and the jury returned the guilty verdict in about 25 minutes," said Asst. Deputy District Attorney Dannica Molina, as cited by the Turlock Journal. Molina, who led the prosecution of this case, further highlighted that Garcia and the victim were not previously known to each other, a fact Garcia admitted during his testimony.

Ivan Garcia Jr. is set to be sentenced on September 4 where he could potentially receive a maximum term of eight years in prison, after being found guilty of the charge. California law dictates that such offenses can result in varied sentencing of three, six, or eight years. Following the sentence, Garcia will also have to permanently register as a sex offender. Assistance was provided to the victim by the District Attorney’s Victim Services Unit, while the California Department of Justice conducted forensic and DNA testing to support the investigation.
