In a turn of events that has rippled through the San Antonio community, Bexar County prosecutors have dropped the charges against former Police Officer Oscar Cruz, who was indicted on charges of Deadly Conduct for allegedly firing his weapon at two teens. This decision came after a mistrial was declared earlier this year due to the late disclosure of key information by the prosecutors' office to Cruz's defense team, as FOX San Antonio reports.
The initial trial was plagued by setbacks after a crucial exchange of information between the Civil Rights and Juvenile Divisions within the District Attorney's office failed to make its way to Cruz's attorneys, according to News 4 San Antonio, a misstep leading to a mistrial and reevaluation of the DA's commitment to ensuring that justice is maintained, transparency upheld. The charges that were initially brought against the former officer stemmed from an incident where Cruz reportedly discharged his firearm, endangering the lives of two teenagers.
Bexar County Criminal District Attorney Joe Gonzales publicly acknowledged the mistake made by his office in the communication and disclosure of pertinent information, stating, "Our ultimate goal is to seek justice. It is critical that our office give opposing counsel all information they are entitled to," and affirming that, “When, for whatever reason, that does not happen, we will disclose the error. Our disclosure means that this defendant or any defendant is always assured of a fair trial. That’s what justice requires."
