
Cheryl Colburn of Ithaca will stand trial in the 8th Circuit Court in Montcalm County, Michigan, on embezzling from a vulnerable adult, a crime punishable by up to five years. As reported by the Michigan Department of Attorney General, Colburn, 65, allegedly took advantage of her position as the professional guardian and conservator of the victim by appropriating the victim’s belongings, including a utility trailer, an Arctic Cat ATV, and a moped, for her personal use.
According to details furnished by the Attorney General, Colburn was entrusted as guardian from 2021 up until the victim's death in April 2023. During that time, the items were allegedly transferred to her residence instead of reported in the probate court as required. Furthermore, as per the news release, "Guardians and conservators are entrusted with a responsibility to protect and advocate for vulnerable adults in their care," Nessel stated. This case has highlighted an ongoing struggle with elder abuse in the region.
On the front of elder advocacy, the Michigan Elder Abuse Task Force, launched in 2019, has been a hive of activity. Comprising over 55 different public, private, and nonprofit organizations, the Task Force aims to prevent the kind of exploitation that Colburn is accused of. Nessel has been a vocal proponent for tightening the reins on guardians and conservators, supporting bills that would reform Michigan’s guardianship statutes and establish stronger safeguards for the elderly.
