In a recent resolution by the Lancaster County District Attorney's Office, an officer's use of deadly force was deemed justified against 36-year-old Christopher Rivera. The altercation occurred after Rivera was accused of robbing and allegedly raping two employees at the Calm Spa in Penn Township. The incident, which resulted in Rivera being shot while fleeing the scene, took place on August 27, according to Local 21 News.
District Attorney Heather Adams stated, "The law recognizes that police officers have no duty to retreat from making an arrest and allows law enforcement to use deadly force in this precise scenario." This comment came after a thorough evaluation of the circumstances, including Rivera refusing to comply with commands and reaching for what appeared to be a weapon in his waistband. While attempting to evade arrest, Rivera was shot twice and apprehended, subsequently receiving medical attention before being held under guard at a local hospital, as reported by Local 21 News.
Body cameras and mobile video recordings from police vehicles captured the critical moments of the incident. The suspect, later identified as Rivera, emerged hastily from the back door of Calm Spa as officers commanded him to get down and show his hands. Despite their orders, Rivera ran toward the edge of the parking lot and retrieved what seemed to be a firearm from under his shirt. The tension escalated when Rivera looked back at one officer, which led to another officer shooting Rivera in the back and leg, as reported by WGAL.
After the shooting, officers found Rivera in the weeds and took him into custody. Rivera cooperated, showed his hands, and told the officers he had a BB gun, which he then threw away. A black pellet gun that looked like a semi-automatic handgun was found about 20 feet from where the shooting happened, according to the District Attorney's office. Rivera faces charges of robbery, rape, and other related crimes, with bail set at $1 million. The name of the officer involved has not been released.
