
An Oakland County man, Denny DiCapo of Rochester Hills, has been sentenced in the Oakland County Circuit Court to a period of 5 to 20 years in prison for his role in fraudulent business transactions. DiCapo, 64, faced charges of conducting a criminal enterprise and multiple counts of larceny. Michigan Attorney General Dana Nessel announced the conviction yesterday, according to the Michigan Department of Attorney General.
Last year, DiCapo pled guilty to one count of Conducting a Criminal Enterprise and six counts of Larceny by Conversion, as per court documents. Having failed to fulfill the plea agreement terms to cover the $21,000 balance in restitution, he was sentenced as a fourth habitual felony offender. Initially, DiCapo had paid $5,000 toward restitution at the time of his plea.
During the proceedings, Judge Kwame Rowe of the 6th Circuit Court handed down the concurrent sentences, which include 1 to 5 years for each of the counts of Larceny by Conversion, in addition to the longer sentence on the criminal enterprise charge. Using his corporations, Biz Capital Brokerage, Inc. and Energy Acquisition Specialist, Inc., DiCapo defrauded seven victims, persuading them to make refundable good-faith deposits towards business acquisitions that ultimately never occurred. Acting as a broker, he obtained $26,000 through these transactions.
