In a courtroom, three children provided testimony against Timothy Allen Daugherty, a former substitute teacher at Spring Mills Elementary, who faces allegations of criminal sexual conduct. As reported by CBS News Detroit, the hearing held yesterday moved forward amidst heavy emotions, with testimonies heard from minors as young as 9 years old. Daugherty stands accused of six counts of second-degree criminal sexual conduct, charges that have notably shaken the Highland Township community.
The gravity of the situation intensified as the court, striving to protect the young witnesses, closed off the testimony segment from the public, and even parents were excluded during this portion. Despite being out on a $75,000 bond, Daugherty was present at the hearing, according to FOX 2 Detroit. A parent of one of the victims, identified only as Ericka, expressed faith in the legal process but also acknowledged the frightening situation for the children involved.
Following the young witnesses’ accounts, the judge determined there to be sufficient evidence to proceed to trial, a ruling that could potentially lead to a fifteen-year prison sentence if Daugherty is found guilty. Representing at least 11 families, attorneys are gearing up to file a civil lawsuit, pending access to a copy of the police report, outlined in the details shared by CBS News Detroit.
Meanwhile, the substitute teacher's attorney, Roy Cassar, expressed disappointment in the case heading to trial, critiquing what he perceived to be a low standard of proof. "The three individuals liked this teacher. They all hugged him and said everyone hugged him. All the hugs were done in the classroom. Some of the hugs were in front of the other teachers. It wasn’t until one of the other students found or talked to her mother who said it might be inappropriate that, all of a sudden, they started to think this may have been inappropriate touching," Cassar told FOX 2 Detroit.
Parents have not only criticized Daugherty but are also planning a lawsuit against the Huron Valley School District, alleging negligence in addressing initial reports of misconduct. As one parent conveyed to clickondetroit, they were made to feel as though their concerns were disregarded. The district, however, has stated that they are cooperating with law enforcement and had removed Daugherty from his position as soon as the allegations surfaced. The date for the trial remains to be set.
