The trial of Taiseer "Taz" Zarka, the owner of Taz's Supermarket in Raleigh, began today, with opening statements addressing the second-degree murder charge against Zarka for the fatal stabbing of a customer. According to WRAL, Zarka is accused of killing 27-year-old Mark Garrity in April 2023, and the incident's surveillance video is expected to be shown during the trial.
A report from The News & Observer states that the confrontation between Zarka and Garrity began over an accusation of stolen drinks, which escalated into an argument and resulted in Zarka allegedly stabbing Garrity with a folding pocketknife several times, prosecutors claim surveillance footage to be presented will provide evidence of the altercation. A pool of 45 jurors was narrowed down to 12, along with two alternates after intensive questioning, to ensure an unbiased process and an understanding of the duty to find probable cause.
The defense, as mentioned by WRAL, asserts that Zarka acted in self-defense and intended only to retrieve the Gatorade from Garrity's bag when a fight broke out; this point is expected to be a significant part of Zarka's testimony. Furthermore, despite the fact that Garrity apparently attempted to steal a Gatorade, the state concurred that his alleged actions did not warrant a fatal response.
Details surrounding the incident note that Garrity was found with stab wounds and eventually died in the hospital as a result, an employee from Taz's Supermarket recounted to WNCN that the dispute began after Garrity was accused of theft; a criminal record including previous guilty pleas for felony breaking and entering was part of Garrity's past, The News & Observer reports. The trial continues as the jury reviews the evidence, including the crucial video evidence of the incident.
