
The legal case over Line 5, a pipeline under the Straits of Mackinac, continues in court. Michigan Attorney General Dana Nessel's team recently presented arguments to Judge James S. Jamo, stating that the pipeline's 1953 easement violates the Public Trust Doctrine and describing its presence as an environmental and public concern, according to the Michigan Department of Attorney General.
Attorney General Nessel criticized Enbridge for using legal tactics to delay decisions on a critical issue affecting Michigan residents. She stated, “Enbridge has deliberately caused years of delay through procedural tactics, attempting to block Michigan courts from deciding a critical issue that directly impacts its residents.” The controversy peaked in summer 2020 when Judge Jamo temporarily halted the pipeline's operations following damage from an anchor strike, as stated by the Michigan Department of Attorney General.
Michigan Attorney General Dana Nessel secured a decision to keep the Line 5 pipeline case in state court after the Sixth Circuit Court of Appeals denied Enbridge’s request to move it to federal court. Judge Jamo has taken the case under advisement and will issue a written ruling at a later date, as reported by the Michigan Department of Attorney General.
