A Honduran man, previously ousted from the United States on six occasions, has again found himself in hot water, this time facing federal charges for illegal re-entry into the country. As reported by the U.S. Attorney's Office, Melvin Armando Funes-Canales was apprehended in Austin and could face a decade behind bars if convicted.
Funes-Canales had been cooling his heels in Williamson County Jail since July 16, 2024, after being busted for alleged possession of a controlled substance. Handed over to federal custody, it surfaced that he was previously deported to Honduras almost four years earlier, on October 9, 2020. His track record marred by past convictions for burglary, grand theft, and repeated illegal re-entries. U.S. Attorney Jaime Esparza announced the arrest.
The court documents lifting the veil on his history hint at an individual who has made crossing borders a part of his life's tapestry. Funes-Canales now faces this single charge of illegal re-entry, a charge that carries considerable weight. The district court will be the stage where his fate is decided, taking into account both the U.S. Sentencing Guidelines and a range of other legal factors.
The case is presently under the microscope of Immigration and Customs Enforcement. Assistant U.S. Attorney Matt Harding is the lead on prosecution duties, drilling down on this latest chapter of Funes-Canales's run-ins with immigration law. While the gravity of the charges looms large, it is essential to recall that "a criminal complaint is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law," as the U.S. Attorney's Office official statement reminds us.
