A Mexican national has been handed a sentence of just over three years in federal prison for the illegal act of reentering the United States after a prior felony conviction. Martin Martinez-Ballinas, 38 years of age, pleaded guilty to the charge in January 2025 and has now been sentenced to 37 months, with a subsequent year of supervised release, according to statements released by the U.S. Attorney's Office for the District of Maryland.
The former court filings have revealed that, before this recent reentry, Martinez-Ballinas was deported twice from the U.S. His first deportation came in 2020, after a conviction in Maryland for a felony related to a traffic accident that resulted in the death of an off-duty Marine. Martinez-Ballinas's attempts to quickly rejoin the country were thwarted in 2021, when the U.S. Border Patrol caught him trying to slip across the southern border into Texas.
For that first illegal reentry, a court in the Southern District of Texas sentenced him to 15 months in prison following his conviction. After serving this sentence, Martinez-Ballinas was removed to Mexico again in October 2022. However, by December 2023, he "knowingly and intentionally" reentered the U.S., only to be detained by ICE in Maryland; this led to the recent sentencing, as detailed in a report by FOX Baltimore.
Kelly O. Hayes, U.S. Attorney for the District of Maryland, has since commended the work of ICE-ERO in the investigation. "Martinez-Ballinas previously pled guilty in January 2025," Hayes was quoted as saying. ICE-ERO Acting Field Office Director Nikita Baker and Department of Justice attorneys Christopher Ting and Joshua Rosenthal were also acknowledged for their roles in prosecuting the case.
