
The New York Attorney General's Office has launched an investigation into a recent civilian death in Orange County, following an altercation involving state troopers and a woman allegedly armed with what turned out to be an imitation firearm. The incident, which resulted in the death of Nancy Loftus, occurred last Saturday, in the town of Deerpark, as per the Attorney General's Office.
According to details released by the Attorney General's Office, state police were responding to a 911 call reporting an assault with a knife at a residence when they encountered Loftus outside holding what appeared to be a gun. After instructing her to drop the weapon, and presumably perceiving a threat, troopers discharged their weapons, striking Loftus. She was subsequently pronounced dead at a local hospital, the presence of an imitation pistol was confirmed by troopers at the scene, marking a tragic end to the encounter.
The Office of Special Investigation (OSI) is now tasked with reviewing this incident thoroughly as per New York State Executive Law Section 70-b, which mandates an assessment of incidents where a police or peace officer may have caused a person's death, whether through action or omission. This protocol applies regardless of the decedent being armed or unarmed, in custody or not, and extends to both on-duty and off-duty officers.
While the OSI's inquiry remains in its early stages, and the preliminary facts released may change as the investigation progresses, questions linger concerning the use of lethal force in situations involving potential mental health crises or the perception of threat by law enforcement. It must be noted, however, that the specifics around Loftus' death and the events leading up to the fatal shooting are still unconfirmed and are currently under close examination by the OSI.
