Three U.S. senators have called for a deeper investigation into the state oversight of assisted living facilities, pushing for clarity on how these institutions protect seniors in their care. According to a letter released on Senator Wyden's official website, the lawmakers seek to ascertain if improvements have been made in safeguarding the hundreds of thousands of seniors in Medicaid-participating facilities.

Highlighting the gravity of the issue, following the investigation by GAO, it was uncovered that state Medicaid agencies, which define critical incidents in various ways, tracked major health and safety incidents in an inconsistent manner. Wyden, serving as the Ranking Member of the Senate Finance Committee, along with Warren and Gillibrand, from their respective committees, underlined that the Centers for Medicare and Medicaid Services might be in the dark about the extent of the problems affecting Medicaid beneficiaries due to a lack of clear federal guidelines.

The push for renewed scrutiny follows damning revelations by The Washington Post detailing the travails of assisted living residents. Reports indicated that thousands have been neglected to the extent of death or gone missing since 2018 because of the failures in supervision and care. Noting these tragic circumstances, the senators emphasized in their letter, "Given GAO’s previous findings on the need for improved oversight of assisted living facilities, and new findings about residents’ health and safety, we request that GAO provide an update on this issue."

The senators' request includes a rundown of the changes in oversight since the 2018 report, identification of recent critical incidents and deficiencies, and how updated monitoring and reporting requirements are being implemented by the Centers for Medicare and Medicaid Services. While seeking this data, the legislators are also questioning what additional oversight might be needed to ameliorate the situation and prevent further neglect. In their concerted efforts, Warren, recognized as the Ranking Member of the Senate Banking Committee, and Gillibrand, the Ranking Member of the Senate Aging Committee, join Wyden in appealing to the GAO for action that will echo across senior care facilities nationwide.
