A Farmington Hills man, Malik Ali Smith, 21, was sentenced to a term of 23 months to 10 years for attacking an 80-year-old man inside the YMCA locker room after the elderly individual asked him to turn down his music, the Detroit News reported.
The sentence was handed down on Tuesday by Oakland County Circuit Court Judge Victoria Valentine, and notably, included a credit of 452 days for time served and constraints prohibiting Smith from entering the Farmington Hills YMCA or contacting the victim's family, according to FOX 2 Detroit, the March 2024 incident had severe consequences, with the elderly victim sustaining brain damage and now being reliant on extensive medical care and assistance for daily activities, which differs substantially from his previously active lifestyle where he engaged in regular social and physical activities.
During the emotional court hearing, the family of the victim expressed their grievances, with one woman recounting her father's active social life before the attack and a son-in-law illustrating the gravity of the injuries by likening them to those sustained in a car crash, as gathered by FOX 2 Detroit. A third family member reflected on Smith's future, lamenting the life he could have led had he chosen a different path, saying, "Look at all the people that are here for him. I think that's the only thing that gives me hope is that, maybe I hope he'll have remorse for what he did. But if nothing else, I hope he has remorse for what he's put his family through that cares so much about him."
Oakland County Prosecutor Karen McDonald called the attack "vicious" and "senseless," as also reported by CBS Detroit. The defense said Smith, who has bipolar schizoaffective disorder, wouldn’t get proper treatment in prison. The judge noted that Smith has changed since the incident before giving her sentence.
Smith addressed the courtroom himself expressing remorse and vowing to make amends, his statement read, "It is my responsibility to take the first initiative and do everything in my power to de-escalate tensions and remove myself by any means necessary," and he continued by making a promise to make it a personal goal, to leave this world a better place, words reported by FOX 2 Detroit after the defendant's courtroom statement.
