A Honduran national, convicted of assaulting a U.S. Border Patrol agent has been given an eight-year sentence by a federal court today. The physical confrontation occurred during an attempted illegal entry near Spofford on August 17, 2024, with Trinidad De Jesus Madrid-Rivas being the assailant.

The altercation unfolded when Madrid-Rivas, alongside another individual who was also attempting to cross the border illegally, attempted to quickly flee from the U.S. Border Patrol agents. Upon being approached by an agent, Madrid-Rivas resisted arrest. The struggle escalated to violence with the defendant aiming to choke the agent, attempting to disarm him, and even ripping the agent's earpiece and baton away, according to court documents detailed by the U.S. Attorney’s Office for the Western District of Texas.

During the scuffle, Madrid-Rivas managed to unholster the agent's gun, which discharged in the struggle. The agent suffered injuries to his hand and neck but ultimately discharged a single round and regained control of the situation. Madrid-Rivas initially fled but was soon apprehended by the authorities. On January 8, Madrid-Rivas pleaded guilty to one count of assaulting, resisting, or impeding certain officers or employees.

Additionally, prior to this incident, Madrid-Rivas was convicted in 2023 of felony assault on a peace officer during a burglary encounter, demonstrating a pattern of confrontations with law enforcement. "Understand that we greatly value the efforts of our local, state, federal, and tribal law enforcement partners, and we will aggressively prosecute anyone who obstructs or assaults these men and women who risk their lives to keep our nation secure," U.S. Attorney Justin R. Simmons said, as reported by the Department of Justice. The U.S. Border Patrol took charge of the investigation, with Assistant U.S. Attorney Matt Kass leading the prosecution.
