
The United States Department of Justice has recently made public an indictment against Fredy Herrera-Castro, a 44-year-old Mexican national, on charges of illegal re-entry after deportation, facing up to a decade behind bars if convicted. According to a statement on the DOJ website, Herrera-Castro has been previously removed from the U.S. five times and holds convictions for similar charges in 2019 and 2020.
Herrera-Castro's indictment alleges that he was found in the United States voluntarily on May 30, 2025 without having obtained proper authorization to reapply for admission from the Attorney General or the Secretary for the Department of Homeland Security, the requirement laid upon him due to his prior criminal record and subsequent deportations, he now faces a maximum penalty of 10 years in federal prison if found guilty in his current case.
It's important to note that an indictment is a formal accusation, not evidence of guilt, and under U.S. law, every individual is presumed innocent until proven otherwise in a court of law. The investigation led by U.S. Immigration and Customs Enforcement (ICE) Enforcement Removal Operations (ERO) culminated in this action, and Assistant United States Attorney Jeff Chang will carry out the prosecution.
