Milwaukee has taken a decisive step in youth protection by unanimously passing an ordinance that prohibits the sale of hemp-derived THC products to anyone under 21. The Milwaukee Common Council gave its full support to file #250439, an initiative focused on preventing young people's exposure to substances such as Delta-8 THC, Delta-10 THC, and similar compounds. According to a press release from the City of Milwaukee, the measure, authored by Alderman Peter Burgelis, drew co-sponsorship across the board and now awaits Mayor Cavalier Johnson's signature.

"This is not just a city ordinance, it’s a significant public health milestone," Alderperson Zamarripa said on City of Milwaukee, who sees the broad implications of such a policy. While adding strong protections for the city's youth, they were echoed by parents, educators, and health professionals who have long demanded protective measures. The new law, which leaves non-intoxicating products like CBD unaffected, introduces penalties for sellers ranging from $400 to $1,000 for each offense.

Amid concerns over the marketing practices that mimic candy, leveraging appeal to younger demographics, Alderman Burgelis emphasized the urgency behind the legislation. "At a time when state leaders have failed to act, Milwaukee is stepping up," he told the Milwaukee Common Council. "These products are often marketed like candy. With this ordinance, we’re closing a dangerous loophole and putting the safety of young people first. Milwaukee has delivered for its residents," as mentioned on the City of Milwaukee website.

The federal government reclassified these products back in 2018, but state-level actions have been varied and often sparse. With this ordinance, Milwaukee sets a precedent for municipalities taking matters into their own hands when broader governance remains silent.
