
In a move against California's "green energy" vehicle emission standards, Texas Attorney General Ken Paxton has teamed up with America First Legal, aligning with former President Donald Trump in ongoing litigation. Paxton made it clear that Texas stands firmly opposed to California's regulatory overreach, with an assist from Trump who signed a law in 2025 revoking California's right to set its own emissions standards under the Clean Air Act, according to the Texas Attorney General's Office.
Without mincing words, Attorney General Paxton stated, "I am standing with President Trump in his effort to stop Gavin Newsom and California from shoving its insane so-called ‘green energy’ vehicle standards down the Nation’s throat," emphasizing Texas will not tolerate California's impact on the nation's energy autonomy and pushing back against policies perceived as detrimental to other states, as reported by the Texas Attorney General's Office. The state of play sees Texas challenging California's environmental ambitions, as they fear such regulations could potentially impact the local oil and natural gas production, Paxton asserts that California's regulations are egregious and harmful to both the economic interests of Texas and consumer choice.
Additionally, Daniel Epstein, Vice President of America First Legal, criticized California's endeavors, claiming the state's approach was not rooted in a desire for innovation but rather an abuse of the legal system to undermine federal law and inflict California's progressive policies across the United States. "America First Legal stands proudly with the State of Texas to defend competition, consumer choice, and the rule of law. We will not let Gavin Newsom remake America in California’s image," Epstein told the Texas Attorney General's Office.
In their legal stand, Texas, joined by America First Legal, supports President Trump's administration which found itself the target of a lawsuit from California seeking to maintain its auto emission standards that proponents of the lawsuit believe are crucial for combating climate change; despite the Trump Administration's formal nullification of the state's previously granted waiver; Paxton stands determined to ensure that the choice of vehicles remains in the hands of Texans, rather than succumbing to mandates from California’s environmental regulatory framework, setting the stage for a high-stakes legal debate on the balance of state and federal power over environmental policy.
