
In a recent presidential action, a new layer of economic sanctions has been imposed, targeting India for its indirect importation of Russian oil. The White House announced that as a measure to address the ongoing national emergency related to Russia's actions in Ukraine, the U.S. will implement an additional 25% ad valorem duty on imports from India. This stern response comes as an expansion of the measures outlined in Executive Order 14066, which already prohibited the importation of Russian origin crude oil and petroleum products into the United States.
The decree, signed yesterday and published by the White House, outlines that these tariffs will take effect 21 days following the order for all relevant goods entering U.S. customs territory. However, as outlined in the order, goods that were loaded onto a vessel at the port of loading and in transit on the final mode of transit prior to entry into the United States before the effective date are exempted, provided they are entered for consumption before September 17.
The executive order also describes provisions that this additional duty will stack upon existing tariffs unless specific exemptions apply, as in the case of goods covered under Executive Order 14257. This move is described as necessary to counteract the "unusual and extraordinary threat to the national security and foreign policy of the United States," contributed by the policies and actions of the Russian Federation, particularly in the context of their continued aggression in Ukraine, as noted by the White House.
This is not solely an isolated incident of tariff imposition; the order enables monitoring of other nations that could be indirectly importing Russian oil. Should any be identified, recommendations may be made for similar actions against them. The Secretary of Commerce, in coordination with other high-ranking officials, has the task of ascertaining whether any other country qualifies for such tariffs. The order allows for further modifications, should there be significant changes in the behavior of the Russian government or any retaliation by other nations affected by these sanctions.
