San Antonio District 8 Councilwoman Ivalis Meza Gonzalez walked out of a Bexar County courtroom on Monday with one key development in her summer DWI case: more time. After a brief pre-trial hearing, the judge granted her legal team a short reset and moved the case down the docket. Gonzalez did not enter a plea and told reporters the matter is still in the discovery phase, as reported by News for San Antonio.

Gonzalez called the appearance "a routine reset" recommended by her attorneys, according to News for San Antonio. Her defense team told the judge it needs additional time to gather and review evidence before the next court date.

How the stop unfolded

Police say officers pulled Gonzalez over just after 11 p.m. in late July on westbound Interstate 10 near Hildebrand after watching her drift across lanes, an interaction captured on body-camera video. According to a City of San Antonio press release, officers evaluated Gonzalez for signs of impairment and took her into custody, and traffic stop on I-10 coverage detailed the initial arrest.

What officers say the tests showed

Court documents outline several alleged sobriety-test failures. The arrest affidavit lists six of six clues on the horizontal gaze nystagmus test, seven of eight clues on the walk-and-turn, and two of four clues on the one-leg stand, as reported by WOAI. Officers also wrote that Gonzalez had watery, glossy eyes and a moderate odor of alcohol, even as she repeatedly denied drinking on video.

Refusal, blood draw and the charge

Court records state that Gonzalez declined to provide a breath or blood sample at the scene, prompting officers to obtain a warrant for a blood draw. Prosecutors later refiled the case to reflect a blood-alcohol concentration of at least 0.15, nearly double the legal limit, a level that can elevate the allegation to an enhanced DWI, according to the San Antonio Express-News.

Political fallout

The arrest has already carried political consequences. In September, the City Council voted to censure Gonzalez, and Mayor Gina Ortiz Jones suspended her committee assignments while the case plays out, per KSAT. Gonzalez has said she will take responsibility and continues to serve District 8 as the legal process unfolds.

What's next

Judge Alfredo Ximenez reset the case and gave the defense about a month to continue reviewing evidence before the next court appearance, according to court reporting. Gonzalez has not said whether she plans to fight the charge or pursue a plea deal, and public records show she won the District 8 seat in the June runoff, per the City of San Antonio.
