A brutal predawn home invasion on Avenue Q that haunted Houston for nearly three years has now led to capital murder charges for three local men. Police say the 2022 shooting left two men dead and a third wounded, and this week they named the suspects as 22-year-old Damien Vega, 23-year-old Raul Gallegos and 24-year-old Jacob Lee St John.

Arrests and Charges

According to the Houston Police Department, all three men are charged with capital murder, with their cases assigned to the 177th Criminal District Court. Investigators with the Southeast Patrol Division's crime suppression team arrested St John on Dec. 9, while Vega and Gallegos were already in the custody of the Texas Department of Criminal Justice on unrelated charges.

How the Attack Unfolded

The home invasion happened at about 3:10 a.m. on Jan. 21, 2022, when multiple masked suspects forced open the front door of a residence in the 7100 block of Avenue Q and opened fire, as reported by the City of Houston newsroom. An initial bulletin from HPD stated that two men were shot and a third man was assaulted. All three victims were transported to an area hospital, where one was later pronounced deceased.

Victims and Timeline

Police later identified two of the victims as 37-year-old Apolonio Alvarado and 41-year-old Juan Ramirez. Alvarado was pronounced dead at the hospital shortly after the shooting, while Ramirez died from his injuries on June 1, 2023. A third male victim was treated and released with non-life-threatening wounds, according to the Houston Police Department.

In the days after the attack, relatives publicly pleaded for answers. The son of one victim, speaking to ABC13 as investigators worked the scene and documented multiple evidence markers, said, "They're wrong for choosing the wrong ones."

What Capital Murder Means Here

Capital murder is an elevated homicide charge under Texas law that applies in cases meeting specific statutory aggravating circumstances and is punishable by death or life without parole, according to the Texas Department of Criminal Justice. Prosecutors must prove one of the factors listed in Penal Code §19.03 for the capital charge to stand; if they cannot, the defendants could instead face lesser homicide charges.

HPD has asked anyone with information about the case to call the Homicide Division at 713-308-3600 or Crime Stoppers at 713-222-TIPS, as noted by the City of Houston newsroom. Arraignments and other court dates had not yet been announced, and prosecutors and the 177th Criminal District Court had not immediately released additional details.
