
Las Vegas short-term rental owners are relieved after a federal court issued a preliminary injunction temporarily stopping Clark County from issuing fines and penalties. Louis Koorndyk, a property owner facing over $100,000 in fines, said, "It's not like that disappears," according to 8 News Now.
The lawsuit, which includes Airbnb and the Greater Las Vegas Short-Term Rental Association, challenges county rules aimed at limiting "party houses" through licensing requirements. Jacqueline Flores of GLVSTRA said, "The ultimate goal is that the county stops attacking property owners, that they start protecting property rights," as the court noted potential due process violations in the county's system, as reported by 8 News Now.
"Under the present circumstances—where prospective short-term renters are effectively barred from applying for a license in the first place, and the County's untimely processing period leaves pending applicants exposed to unfair enforcement penalties in the interim—the County has deprived Plaintiffs of a protected property interest without providing any meaningful process," Judge Du stated in her order, as per News 3LV. The injunction will stay in place until a final ruling, temporarily protecting applicants from needing a short-term rental license, liens, and other penalties. The county is reviewing the ruling and has not commented on the ongoing case.
