The tragic death of 19-year-old Brianna Aguilera, a Texas A&M student who fell from a high-rise apartment in Austin after allegedly being overserved alcohol, has led her parents to file a wrongful death lawsuit. Manuel Aguilera and Stephanie Rodriguez are seeking upwards of $1 million from the Austin Blacks Rugby Club and the UT Latin Economics and Business Association, claiming gross negligence on the part of these organizations in connection to their daughter's death on November 29, according to ABC7 Amarillo.
The suit filed in Travis County suggests that Aguilera attended a tailgate party hosted by the defendants on the day of her demise. Despite being underage, she was allegedly served alcohol for several hours, contributing to her heavily intoxicated state. Later that evening, events took a fatal turn when Aguilera fell from a 17-story building. Tony Buzbee, leading attorney with the Buzbee Law Firm, expressed in a statement obtained by ABC7 Amarillo, "she was not 21," emphasizing the illegality of the service provided to her.
The family's dissatisfaction with the Austin Police Department's handling of the investigation has been loud and clear, with calls for the Texas Rangers to take over the case. The authorities initially ruled Aguilera's death as a suicide, a conclusion her family fervently disputes. In pursuit of further evidence, Buzbee has stated that the lawsuit will open the door to subpoena vital information, thus intensifying the investigation into the night's events, as reported by ABC7 Amarillo. The belief is that the actual chain of events leading up to Aguilera's fall is not only an accident, but could also reflect something more sinister.
Further discord arises from a discrepancy in timelines. The Austin Police Department maintains that Aguilera attended a tailgate party from 4 to 10 p.m., arrived at the 17th-floor apartment around 11 p.m., and died shortly after a 12:30 a.m. phone call to her boyfriend. However, Buzbee contends that the department's timeline doesn't match up with information received from other witnesses, as Fox San Antonio reports.
