Deputies say a bike dispute at a north Houston apartment complex ended with a 9-year-old girl getting hit and a man hauled off to jail.
On Thursday, Harris County Precinct 4 deputies responded to a disturbance call at the La Esencia Apartments in north Houston after reports that several children's bicycles left outside had been taken. When one child tried to get her bicycle back, she was struck, according to authorities. Deputies say they found the suspected attacker still at the complex, detained him at the scene, and booked him into the Harris County Jail on an injury-to-a-child charge. Investigators say the case remains under active review.
According to Constable Mark Herman, deputies were dispatched Thursday to the La Esencia Apartments in the 300 block of N. Vista Drive after calls about both the bike thefts and the reported assault. The constable's office says deputies identified the suspect as Jose Ayala (DOB Oct. 12, 1955). He was arrested and taken to the Harris County Jail, and the post notes that bond had not yet been set by the 487th District Court at the time of the announcement.
What the Charge Means
Under Texas law, an "injury to a child" charge applies when someone 14 or younger suffers bodily or serious bodily injury because of another person's actions or failures to act. Depending on the level of harm and the accused person's intent, the offense can range from a state jail felony to a first-degree felony. The crime is spelled out in the Texas Penal Code Section 22.04, which lays out the legal elements and possible punishment ranges.
Bicycles and Neighborhood Safety
Precinct 4's post also notes that the suspect is accused of taking multiple unattended children's bicycles, highlighting how easily unsecured bikes can disappear in apartment complexes and other shared spaces. Experts say that kind of target can invite opportunistic thefts.
Guidance from the Houston Chronicle recommends promptly reporting stolen bikes to law enforcement, keeping serial numbers and photos handy, and using sturdier locks to boost the odds of recovering a missing ride.
How Neighbors Can Help
The constable's office is asking anyone with information, camera footage, or other tips related to the incident to contact Precinct 4 dispatch. The office's contact page lists non-emergency phone numbers as well as its "C4 NOW" app, which residents can use for neighborhood alerts and communication.

As with any arrest reported by law enforcement, the charge against Ayala is an allegation at this stage. He is presumed innocent unless and until he is proven guilty in court. This story will be updated as court filings and official records become available.
