Authorities say a routine shopping trip at a Kohl's in Apex turned into a criminal case earlier this month, ending with the arrest of a Raleigh man now facing multiple charges tied to what investigators describe as a sexual incident inside the store.
According to charging documents, 25-year-old Brian Izael Cruz of Raleigh is accused of secretly photographing or recording a woman inside the Kohl's, exposing himself and making nonconsensual physical contact with her. The warrant states the alleged conduct was for the purpose of sexual arousal or gratification. The Apex Police Department listed charges that include felony secret peeping, sexual battery, indecent exposure and assault on a female. Officers arrested Cruz on Tuesday in connection with the April 16 incident, and records show he is currently in custody.
Charges and allegations
A warrant filed by the Apex Police Department, as reported by WTVD/ABC11, alleges that Cruz photographed or recorded a woman inside the store without her knowledge, exposed himself and then made nonconsensual physical contact. The charging documents specify that the behavior was allegedly carried out for sexual arousal or gratification. These remain allegations that have not been proven in court.
Arrest and court date
Apex police arrested Cruz on April 28 and booked him into the Wake County Detention Center, where he is being held without bond, according to WRAL. He is scheduled for a first-appearance hearing in Wake County District Court, the outlet reports. Prosecutors will decide whether to pursue any additional charges as the investigation moves forward.
Triangle trend
Local coverage has noted a series of indecent-exposure and sexual-battery reports around the Triangle this year, underscoring that such cases can unfold in everyday public settings like stores and parks. ABC11 has reported on similar arrests and investigations across Wake County. Police continue to urge anyone with video, photos or direct knowledge of incidents to contact investigators so potential evidence can be evaluated by prosecutors.
What's next
Cruz is presumed innocent until proven guilty, and the charges remain allegations that will be addressed in his upcoming district court appearance. The warrant and arrest records indicate that the investigation is still active, and additional filings or court dates could follow as prosecutors review the case.
