A quiet Delafield ride on an electric bike turned into a police case last week when, according to authorities, a 73-year-old man pulled a handgun and pointed it at a 13-year-old boy. The incident unfolded last Wednesday (April 22) near the intersection of Cushing Park Road and Abitz Road. Deputies later tracked the man to his home in Summit and arrested him. As of Monday afternoon, prosecutors had not yet filed charges.
What authorities say
According to a spokesperson for the Waukesha County Sheriff's Department, the man tried to confront the boy on Wednesday afternoon, but the teen kept riding away on his e-bike. At that point, the man allegedly drew a handgun from his hip and pointed it at the boy, the spokesperson said. Deputies arrested the 73-year-old at his Summit residence, and WISN 12 News reports that prosecutors had not filed any charges as of Monday afternoon.
Trail and neighborhood context
The intersection where the confrontation took place sits just off Cushing Memorial Park and the Lake Country Trail, a corridor that draws regular traffic from local cyclists, runners, and families. As noted by Visit Delafield, the route is a go-to for recreational rides and quick neighborhood trips, making the reported gun incident especially unsettling for residents who frequent the area.
Possible charges under state law
Under Wisconsin law, intentionally pointing a firearm at another person is treated as a weapons-related offense, with specific elements such as intent or recklessness that prosecutors must weigh. The Wisconsin State Law Library includes jury instructions on "intentionally pointing a firearm" and related endangering-safety provisions that could come into play here. Whether the conduct in this case meets those standards will be up to prosecutors as they review the investigation.
What's next
The case remains under investigation and will be reviewed by prosecutors to decide whether charges are warranted, according to WISN 12 News. The Waukesha County Sheriff's Office, which handled the arrest, is asking anyone with additional information to contact the department.
