A Deltona man is facing a stack of charges after deputies say a Sunday drive turned into a rolling gunfire incident, capped off with a crash into a livestock fence and several mailboxes. A nearby resident’s 911 call led deputies to the SUV, where they say they found the weapon and its driver, identified as 34-year-old Justin Michael Hall of Deltona.
Shots Reported On East Kicklighter Road
According to an arrest affidavit, a witness called 911 after hearing gunshots near East Kicklighter Road and Sand Crane Lane and reported seeing a white Chevy Tahoe firing multiple rounds as it went by. Deputies later tracked down the Tahoe, recovered a short-barreled AR-15-style rifle from inside the vehicle, and took Hall into custody.
Hall provided breath samples of 0.194 and 0.191, well over the legal limit, and the owner of the damaged livestock fence told deputies he wanted to pursue charges, according to WESH.
Charges And What They Mean
Hall is accused of DUI, discharging a firearm from a vehicle, possession of a short-barreled rifle, and tampering with evidence. Under Florida law, possessing a short-barreled rifle is unlawful and treated as a second-degree felony, as outlined in Florida Statutes (790.221).
Driving with a breath-alcohol level of 0.08 or higher is a per se DUI offense in Florida, with definitions and penalties spelled out in Florida Statutes (316.193). Prosecutors will ultimately decide how each of these alleged violations is formally charged in court.
Neighbors And Damage
People living along the rural stretch of East Kicklighter Road told deputies they heard a series of pops as the Tahoe passed by, then later saw the SUV had struck mailboxes and a livestock fence. The fence owner told deputies he intends to press charges over the damage.
Volusia deputies are continuing to investigate both the reported gunfire and the crash, as reported by WESH.
Next Steps
The case is headed into the Volusia County court system, where prosecutors will determine the final list of charges and set the timing for Hall’s arraignment. The Volusia County Sheriff’s Office is listed as the investigating agency and maintains public reports and contact information on its website for anyone with tips or additional information.
