
A homeless man in his 30s was shot and killed Wednesday after a homeowner confronted him over alleged trespassing in a northeast Houston subdivision. The man was later found dead in a ditch near a playground off the 9600 block of Tidwell, and Houston police say the shooting remains under active investigation.
What police say
According to Click2Houston, officers were first called to the neighborhood for reports of a suspicious person, after multiple homeowners complained about someone cutting through backyards and going into homes that were still under construction. Investigators say a homeowner confronted the man outside a vacant house. The man walked away, but police say he circled back through a wooded area, where the confrontation turned physical and the homeowner fired a pistol.
The man ran off and was later found dead in a ditch near the playground. Authorities have so far identified him only as a man in his 30s. Police say the homeowner has been cooperative with investigators, and no charges have been announced while detectives continue gathering evidence.

Texas law allows the use of deadly force in limited situations when a person reasonably believes it is immediately necessary to protect themselves, and the Penal Code includes a "presumption of reasonableness" in some cases involving unlawful entry, according to the Texas Penal Code.
