State agents are investigating a deadly confrontation in the Town of Lake Tomahawk after a Wednesday morning arrest attempt ended with a person shot and killed by a Oneida County Sheriff’s deputy.
Authorities said two deputies went to the 5000 block of Lumen Lake Drive at about 10:30 a.m. to arrest a subject tied to a felony investigation. When they made contact, the person produced a firearm and fired. One deputy shot back, hitting the subject. Emergency medical crews later pronounced the person dead at the scene. No deputies or bystanders were injured.
State Agents Take Over The Probe
The Wisconsin Department of Justice’s Division of Criminal Investigation is now leading the case, with help on scene from a DCI crime response specialist and several local agencies, according to WSAW. Investigators are working to piece together exactly what unfolded along Lumen Lake Drive in the minutes before the shooting.
What State Law Requires
Under Wisconsin law, any death that results directly from a law enforcement officer’s action or omission must be investigated by an independent agency. The DOJ’s Division of Criminal Investigation frequently serves in that role. The division prepares investigative reports and turns them over to prosecutors, who decide whether any criminal charges are warranted, according to the Wisconsin Department of Justice.
Deputies Placed On Administrative Assignment
Both deputies involved in the incident will be placed on administrative assignment in line with agency policy, the local report notes. Authorities also said there is no known ongoing threat to the public, according to WSAW.
How The Review Moves Forward
DCI investigators will continue gathering evidence and interviewing witnesses before handing their findings to the Oneida County district attorney for review. Officials noted that the timing of that review can vary, depending on forensic testing and how complex the case turns out to be. The identity of the person who died has not yet been released.
