On August 3, 2023, Martin Helda, the 35-year-old owner of San Jose flooring company All Bay Floor, was sentenced to four months in county jail and ordered to pay over $580,000 in restitution for committing fraud and failing to pay his employees $1 million in owed overtime. Helda pleaded guilty to three counts of fraud, including wage theft, workers compensation premium fraud, and Employment Development Department (EDD) fraud.
District Attorney Jeff Rosen remarked, "Whatever you think you might be saving in the short term will cost you a lot more than money in the long term. Fraud doesn't pay." The investigation into Helda's business malpractices began after an insurance audit revealed incongruences between his reported payroll and the actual number of employees he had working for him, as mentioned on Santa Clara County Office of the District Attorney. Several organizations, including the DA's Workers' Exploitation Task Force, Department of Industrial Relations, and State Labor Commission, collaborated to gather evidence for the victims.
At least 18 employees were affected by Helda's illicit actions, but authorities believe there may be additional unidentified victims, according to KRON4. Investigators are encouraging past and present employees of All Bay Area Floors who believe they may have been victims to come forward and, if necessary, file a wage claim on the Labor Commissioner's Office website.
