An Oregon Secretary of State audit has chastised the Oregon Medical Board (OMB) for an unreliable disciplinary process after finding that the board's approach to disciplining health care professionals is inconsistent and inequitable. The audit, released Wednesday, pointed out that while the OMB has existing policies to investigate complaints, its process for ensuring equitable disciplinary actions is lacking in formality and regularity, KGW reports.
The audit scrutinized the medical board, which oversees a swath of health care professionals in Oregon, and emphasized the need for a more robust data system. The current system does not support easy analysis of disciplinary decisions, leaving room for discrepancies in the handling of similar cases. According to the board, about 700 to 800 complaints are processed annually. The board's routine of comparing disciplinary outcomes is "generally informal and intermittent," auditors found.
In an assessment aimed at protecting patients and ensuring fair treatment of licensed practitioners, the Secretary of State's audit concluded that the medical board's lack of consistent data analysis undermines its responsibility to enforce the standards set by Oregon’s Medical Practice Act. "While OMB has done qualitative reviews to try to ensure consistency, the database hinders OMB's ability to conduct routine, systematic data analysis to help assure the public and licensees that similar cases result in consistent and equitable disciplinary outcomes," the audit stated as per KGW.
Further highlighting the intricacies of medical complaints, the audit mentioned that medical complaint cases can be complex, often containing specific circumstances within the case or the licensee’s history. Despite apparent similarities between complaints, divergent case specifics might justify different disciplinary measures which makes equitable oversight challenging, shared the audit referenced by Statesman Journal. But, the current data handling by the OMB, often leaves stakeholders in the dark regarding the rationale behind disciplinary discrepancies.
The revelation has thrown a spotlight on the need for the OMB to revamp its data systems and establish more formal mechanisms of accountability. As per the conclusion of the audit, embarking on systematic changes could fortify the public's trust in the medical board's ability to protect its patients and uniformly discipline healthcare professionals under its jurisdiction.
