To address long-standing concerns within the immigration system and promote family unity, President Biden has rolled out new policies aimed at keeping families together while bolstering U.S. security. According to a fact sheet released by The White House, the plan includes a path for certain noncitizen spouses and children of U.S. citizens to apply for lawful permanent residence without the need to leave the country.

This action is poised to affect roughly half a million spouses of U.S. citizens and about 50,000 noncitizen children under 21. To be eligible for this process, noncitizens must have lived in the U.S. for a minimum of 10 years as of June 17, 2024, and be legally married to U.S. citizens, meeting all legal requirements. Once approved, they will be allowed, to stay in the States with their families and receive work authorization for up to three years.

The initiative also extends to certain college graduates, including those under the DACA program and other Dreamers. Those who have earned a degree from an accredited U.S. higher education institution and have a job offer related to their field of study will be able to obtain work visas more expediently. The Administration's stance is that allowing these individuals to utilize their U.S. education and skills is in the nation's best interest.

Furthermore, these changes come on the back of the Administration's prior efforts to defend the DACA policy and extend Affordable Care Act coverage to its recipients. By amplifying lawful immigration pathways, the Administration aims to provide stability to mixed-status families and empower young, educated individuals to contribute to the American economy, detailing measures taken to streamline existing processes and institute new reunification programs.
