
A Butler man has been handed a federal indictment for allegedly possessing a firearm and ammunition, despite having a prior felony conviction. The U.S. Attorney’s Office, Western District of Pennsylvania disclosed the indictment on July 9, with Thomas James Clark, 32, identified as the defendant.
Clark's indictment comes from an incident dated January 20, when he was found to have the illegal items, according to the U.S. Attorney’s Office announcement. Under current federal law, it's a crime for anyone with a felony conviction to own or possess guns or ammunition. If convicted, Clark could face serious penalties including up to 15 years in prison and fines reaching $250,000.
Prosecuting the case for the government, Assistant United States Attorneys Katherine C. Jordan and Kelly M. Locher are leading the legal pursuit against Clark. As detailed in the indictment, the seriousness of the offense and Clark's prior criminal record will influence his sentence, which will be decided within the framework of the federal Sentencing Guidelines.
The Bureau of Alcohol, Tobacco, Firearms and Explosives conducted the leading investigation that brought about Clark’s indictment. This enforcement is part of Project Safe Neighborhoods (PSN), a collaborative initiative to reduce violent crime and gun violence. The Department of Justice enhanced PSN with a new strategy on May 26, 2021, which also includes fostering community trust, supporting violence prevention at the grassroots level, prioritizing enforcement efforts, and evaluating the outcomes of these strategies.
As per the official statement, an indictment is nothing more than an accusation at this stage, and Clark remains innocent until proven guilty in a court of law.
