Javier Joel Perez, a 46-year-old resident of Immokalee, has been sentenced to 8 years in federal prison after pleading guilty to charges related to drug and gun offenses. U.S. District Judge Thomas P. Barber handed down the sentence, as Perez faced consequences for possession of a controlled substance with the intent to distribute, possession of a firearm in furtherance of a drug trafficking crime, and being a felon in possession of a firearm and ammunition. The U.S. Attorney’s Office announced the ruling on July 19, following a guilty plea entered earlier this year on February 21.
Collier County Sheriff's Office deputies, in coordination with the Bureau of Alcohol, Tobacco, Firearms, and Explosives, found marijuana, cocaine, and methamphetamine packaged for distribution during a search at Perez's home. In addition to the drugs, a loaded firearm was also located, an item Perez claimed as his own. Considering his history as a nine-time convicted felon, Perez is barred under federal law from owning firearms or ammunition. Yet in his possession, they were, marking a clear breach of this legal boundary.
Perez's conviction serves as a piece in the larger puzzle of Project Safe Neighborhoods (PSN), a coalition aimed at reducing violent crime and gun violence. This program unites law enforcement at all levels, with a mission to create safer communities across the nation. As part of the Department of Justice's violence reduction strategy announced on May 26, 2021, PSN looks to fortify community trust, back organizations that preemptively tackle violence, set precise enforcement targets, and rigorously gauge the outcomes of these efforts.
The sentencing also comes with a court order for Perez to forfeit the firearm connected to the offenses. Assistant United States Attorney Mark Morgan, who prosecuted the case, remarked on the importance of keeping firearms out of the hands of convicted felons, particularly those involved in drug trafficking. Through this sentencing, the court has not just incapacitated an individual's ability to further these criminal activities, but it has signaled a broader commitment to upholding the core values of PSN and the collective safety of the community.
