
An Oxnard man has been charged with second-degree murder following a fatal fentanyl overdose, marking a first for the Ventura County District Attorney's Office. Rodney Rey Yanez, a resident of Oxnard, stands accused of selling the synthetic drug to Dylan Rusch, who later overdosed and died, according to the Ventura County District Attorney's Office.
In what constitutes a historic move in the county, the case directly addresses the potency and deadly nature of fentanyl. Yanez has also been charged with nine additional felonies and four misdemeanors linked to narcotics possession and sales. District Attorney Erik Nasarenko emphasized the gravity of the situation, stating, "The filing of murder charges in a fentanyl overdose case underscores the grave responsibility we have to protect our community from the devastating impact of this deadly drug," as outlined in a statement released by the district attorney's office.
The incident in question occurred at a gas station on September 20, 2023, where Yanez is alleged to quickly have sold fentanyl to Rusch, with Rusch later being found overdosed in a restroom. Despite the efforts of officers and emergency personnel, he was pronounced deceased at the site. A toxicology report confirmed that a lethal dose of fentanyl resulted in Rusch's death. Yanez was subsequently arrested by the Oxnard Police Department on July 24, and as of the latest developments, his arraignment has been set for August 21, with bail maintained at $1 million, as reported by the Ventura County District Attorney's Office.
