According to court documents, Hernandez is said to have veered his concrete truck into oncoming traffic in Bastrop County, causing a school bus to swerve and fatally overturn. The crash claimed the lives of five-year-old Ulises Rodriguez Montoya, aboard the Hays CISD school bus, and 33-year-old Ryan Wallace, whose vehicle was struck by the concrete truck. The bus was reportedly returning from a field trip with 44 students and 11 adults when the calamity unfolded.

Furthermore, details from an arrest affidavit, outlined by FOX 7 Austin, indicated that Hernandez admitted to having used marijuana the night before the incident and cocaine in the early morning hours, alongside only managing to secure a mere three hours of sleep.

Questions have also been raised about Hernandez's eligibility to operate a commercial vehicle after it emerged that FJM Concrete, his employer, allegedly failed to check a federal database in which he had a status prohibiting him from driving. In April, prior to the accident, the U.S. Department of Transportation's Federal Motor Carrier Safety Administration mandated Hernandez to not operate any commercial motor vehicle.
