According to a report released by the GBI, it was around 10:12 a.m. when the authorities were alerted to a situation involving Jay Berger, who allegedly pointed a gun at a hotel employee. After being confronted by Berger, the residential manager promptly contacted the police upon returning to the ground floor. The responding officers were met with resistance as Berger barricaded himself inside his apartment, escalating the situation and necessitating the deployment of SWAT.

The standoff took a dangerous turn when Berger began firing into the hallway from within his apartment. The GBI's preliminary information indicates one of these rounds may have injured a SWAT officer, possibly due to shrapnel. The violence continued as Berger made his way onto his apartment's balcony, throwing objects down to the street below in disregard for the safety of others. SWAT's response escalated when a sniper, confronted by continuous gunfire, made the decision to shoot, striking Berger.

Following the shooting, SWAT teams were able to enter Berger's apartment and successfully take him into custody. Berger was then transported to a local hospital, with plans to move him to Fulton County jail awaiting charges upon his release. The GBI's investigation remains ongoing, and their completed case file will eventually be handed over to the Fulton County District Attorney’s Office for further review and potential prosecution.
