Maricopa County Superior Court was the setting for a critical hearing last Friday where prosecutors presented new evidence against James Estep, an Arizona man indicted on multiple felony counts, including sexual assault. Estep is accused of a series of sexual assaults and related crimes spanning from 2018 to 2023. This development in the legal proceedings could potentially introduce allegations from two more victims, despite the absence of formal charges in those instances.

Two additional alleged victims were presented in court, both renters in Estep's home during the periods of 2017 and 2020. The fresh details, as reported by ABC15, may inform the court's decision on whether this evidence can be included to illustrate a pattern of aggressive sexual behavior, a motion brought under Rule 404 (C). These cases involve accusations of Estep choking his victims, an indication of his abnormal behavior.

Estep's defense has requested to sever the charges, which could lead to a series of individual trials for each victim, complicating the prosecution's strategy. Former Maricopa County prosecutor Josh Kolsrud expressed concerns to ABC15 about the potential implications for the defense team, stating, "If they are permitted to do this, it's going to be devastating to the defense."

Dr. Tina Garby, a psychologist, testified to describe Estep's alleged crimes as fitting a pattern of sexual deviancy. Charged with crimes as serious as kidnapping, the indictment against Estep details his pattern of behavior toward women, including using deception to lure his victims. This includes an instance in May of 2021, where Estep masqueraded as a pastor to offer a woman a place to stay, only to assault her in an abandoned lot, according to 12 News.

Despite prior arrests in May and June of 2023, Estep was released when the Maricopa County Attorney's Office decided against filing charges, a position Maricopa County Attorney Rachel Mitchell defended by citing insufficient evidence at the time. Following an incident involving a 15-year-old girl, who Tempe police claim was violently assaulted by Estep after he offered her a ride at a light rail station, Estep was arrested again.

With testimony concluded, all eyes now turn to an October 18th round of oral arguments where Judge Mark Brain will rule on the admissibility of the new evidence and the motion to sever charges. Until then, Estep remains behind bars, held without bond as the proceedings continue to unfold.
