Maricopa County Attorney Rachel Mitchell has announced that Brian Kibiwot Chuchuney, born in August 1993, has been sentenced to 20 years in prison following his brutal attack on a 70-year-old woman in downtown Phoenix. The incident, which occurred in the early hours of December 17, 2023, began when the victim, an overnight receptionist at an apartment building, allowed Chuchuney access after mistaking him for a resident.

Once inside, Chuchuney requested some water and proceeded to follow the victim as she turned to fulfill his request, where he then attempted and subsequently sexually abused her. After the attack, he took the victim's clothing and fled. Chuchuney was found and arrested by police a few hours after the incident occurred. “This defendant’s heinous actions and lack of remorse make it clear that he poses a significant danger to the community,” said County Attorney Rachel Mitchell in a statement obtained by Maricopa County Attorney's Office.

In July, Chuchuney pled guilty to one count of Kidnapping, categorized as a Class Two Felony, and to two counts of Attempt to Commit Sexual Assault, both Class Three Felonies. His sentence includes 20 years for the kidnapping and a lifetime of supervised probation for each count of attempted sexual assault.

The victim, conveying the depth of her trauma during her statement to the court, shared with the Maricopa County Attorney's Office, "Your cruelty has hurt me physically, and financially, but above all, the emotional blow you inflicted has shattered my life, capacity to work and severely wounded my family.” This sentence reflects the gravity of Chuchuney's actions and the court's commitment to public safety and justice for the survivor of his crimes.
