
Crackdowns on illegal vaping products have taken a significant turn with Rep. Ruben Gallego's recent correspondence with the FDA and the DOJ. As reported by his official website, the Arizona lawmaker is asserting pressure on the administration, calling for decisive actions against U.S. distributors of illicit, mainly Chinese-made, e-cigarettes.
Gallego pinpointed the urgency of the situation in Arizona, where two of the largest domestic distributors are located. Despite the public nature of their operations, running afoul of federal law, neither has been levied with civil monetary penalties nor faced other enforcement measures. "Every day without action results in more young Arizonans falling victim to addictive products from China," Gallego wrote in a letter calling for intervention.
The congressman stressed the importance of the multi-agency task force, intended to foster collaboration between the FDA and the DOJ in tackling this prevalent issue. His critique of the current lack of enforcement was pointed, emphasizing that distribution within the U.S. and border security are well within the agencies' control, compared to the challenges presented by foreign manufacturers.
With the task force in place, Gallego argues, "inaction on enforcement is no longer tolerable." He is pushing for immediate, impactful enforcement actions that unmistakably demonstrate open defiance of applicable laws will not be permitted. "The task force must issue impactful enforcement actions immediately to send a clear message to the worst offenders that open defiance of applicable laws and regulations will no longer be permitted," he asserted.
Earlier in the year, Gallego's commitment to this issue was evidenced by the introduction of the Vetting and Patrolling E-Cigarette (VAPE) Imports Act. This legislation eyes an additional $5 million for the FDA to intensify their field operations at points of entry and at the eight international mail facilities, with a focus on illicit vaping and nicotine products.
