
Carlos Harris, a man who was supposed to be released early from Santa Clara County Main Jail, remains behind bars due to bureaucratic delays. Last week, Judge Benjamin Williams reduced Harris' sentence, effectively setting the stage for his overdue freedom. However, as reported by NBC Bay Area, his release has been obstructed by the need for clearance from the California Department of Corrections and Rehabilitation (CDCR).
Supporters and family members are deeply frustrated by the holdup, having anticipated his release. "This is not just punishing Carlos," family friend Paul Thacker pointed out, as per NBC Bay Area. Harris' cousin, Aisha Hampton, echoed the sentiment and told KTVU, "We are just really feeling like he’s being illegally detained at this time." The NAACP of Silicon Valley is among the voices demanding his immediate release.
The sheriff's department has stated that CDCR still needs to process Harris' release. A spokesperson indicated that a request for the original court order, which could take additional days or longer, is necessary for confirmation.
Efforts to actively remedy the situation were made by the Sheriff’s Office, including a suggestion to a judge to amend the court order. However, Sheriff's Office officials have been informed of the inevitability of CDCR-related delays to process the release faster. As per a statement from KTVU, "Despite proactive efforts to expedite the process, all parties were informed" that delays for release due to CDCR processing were inevitable. Nonetheless, Harris remains in the county jail during this waiting period, and his actual release date is still undetermined.
