After the victim took out her cellphone to start recording, the assailant, driving a black Mercedes, got out and repeatedly punched her in the face before he was forced to stop when the victim bit him. This brutality was punctuated when Atkinson then used the vehicle almost as a weapon itself, driving it toward the woman, narrowly missing her.

The victim sustained significant injuries including a broken nose, face and head contusions, and a hemorrhage in her left eye. In the shadow of such a violent ordeal, the District Attorney Kevin Hayden praised the woman's courage, saying, "But, even as she was being attacked, she had the presence of mind to record video, and that decision, along with her brave testimony, provided enough evidence for the judge to make his decision."
