The Boulder Police Department, noting the absence of alcohol or drug impairment, has concluded that the fatal encounter was unintentional.

After consultations between Boulder Police Traffic officers and the District Attorney’s Office, it has been determined that no charges will be filed. This has been observed with the understanding that the crash was a tragic accident. Assurances from the police implied the cyclist, Poley was wearing a helmet when the misfortune took place.
